Utterances of explicit performatives, such as “I order you to close the door,” have the forces named by the appearing verbs; here, the utterance has the force of ordering. These utterances utilize declarative sentences, which usually indicate the force of statements, rather than of any verbs contained in them. This leads many to theorize that explicit performatives are statements that cause their hearers to infer the forces they name. This article argues against this account on the grounds that it is (...) based on the false premise that hearers can unconsciously recognize illocutionary forces. L’expression « phénoménologie de la vie » indique une visée commune entre les pensées de Michel Henry et de Bin Kimura. La « phénoménologie historique », telle que conçue par Husserl, trouve l’essence des phénomènes dans le mode d’apparaître des objets par la médiation de la différenciation temporelle. La phénoménologie de la vie saisit cette essence dans une dimension verticale, appelée « immédiateté » par Kimura, qui unit le présent caractéristique de l’être du soi avec la Vie absolue. Elle situe (...) ainsi le fondement de la temporalité dans la genèse spontanée du présent à partir de la Vie absolue. On examine d’abord ici la particularité des phénomènes (soi, monde et autrui) dans l’expérience de l’immédiateté du point de vue de la phénoménologie de la vie, puis on montre que Kimura voit dans la Vie absolue non seulement le principe de la vie, mais aussi celui de la mort. The current study analyzed the relationship between Coronavirus Awareness, mental health, and willingness to seek professional psychological help. This was made through a quantitative approach, using online questionnaires to collect data from 855 subjects. The questionnaires included the Brief Symptom Inventory to measure mental health indicators, the Attitudes Toward Seeking Professional Psychological Help Scale–Short Form, and the Coronavirus Awareness Scale-10. An Exploratory Factor Analysis suggests that three factors underlie the CAS-10: Coronavirus Concern, Exaggerated Perception, and Immunity Perception. Results indicate a (...) significant positive correlation between Coronavirus Concern and both general anxiety and phobic anxiety symptoms. Immunity Perception is positively related to paranoid ideation and psychotic symptoms. A Mediation Analysis determined that Coronavirus Concern has a significant positive direct effect on Openness to Seeking Psychological Treatment, while Exaggerated Perception and Immunity Perception scores have significant direct negative effects on the Value and Need in Seeking Treatment scores. Indirectly, the relationship between Coronavirus Concern and OPST is significantly mediated by anxiety symptoms. Similar results were found for the VNST subscale. There is a negative significant effect of Immunity Perception over OSPT mediated by Paranoid Ideation. However, the overall model only achieved small r2 coefficients for the OSPT and VNST scores. Comparisons in Coronavirus Awareness between sex, age, and the presence of children and older adults at home were also made. These results are discussed regarding their practical implications for mental health providers and policymakers. (shrink)

This paper compares two philosophical views from vastly different intellectual traditions: the views typical of neo-Aristotelian naturalism and the views that Kitarō Nishida describes in his An Inquiry into the Good. I concentrate on the following points. Nishida and neo-Aristotelian naturalists share the view that the mind tends to construct experience as it characterizes phenomena. It evaluates those that fulfill this tendency positively and those that fail to fulfill it negatively. Moral judgment is one manifestation of this tendency. This allows (...) both approaches to claim that the natural goodness/defect that characterizes human beings results from the capacity of rational choice, and that normalcy in developing and exercising this capacity provides criteria for evaluating the moral status of individuals. Nevertheless, they diverge on whether or not the application of these criteria is agent-neutral or agent-relative. Based on these considerations, I argue that Nishida’s view is free from a major difficulty that the neo-Aristotelian naturalist encounters. (shrink)

Nous pouvons distinguer chez Michel Henry « phénoménologie de la vie » et « phénoménologie de la culture » comme étant opposées à la « phénoménologie de la nature ». Avant d’être objective et naturelle, la réalité est toujours vitale et pathétique, et son apparaître sous la forme d’une culture est son mode d’être originel. Par conséquent, la « phénoménologie de la vie », phénoménologie qui, en comprenant ainsi la réalité, cherche dans la vie le fondement de cette réalité toujours (...) apparaissant en tant qu’originairement culturelle, devrait être entendue comme « phénoménologie de la culture ». Dans cette perspective, nous prendrons ici la phénoménologie henryenne comme « phénoménologie de la culture » et on tentera de savoir comment elle comprend la naissance de la culture à partir de la vie, autrement dit, comment elle conçoit la naissance de la culture qui ne fait qu’une avec l’auto-engendrement de la vie. This paper examines assumptions concerning the relationship between citizenship, justice, and well-being, based on representative political philosophies, including egoism, utilitarianism, libertarianism, liberalism, and communitarianism. A previous paper raised the possibility of an inter-disciplinary framework for collaboration between psychology and political philosophy. This study picks up that thread and attempts to actualize a collaborative research effort based on a framework grounded in positive political psychology. The first part of this study reflects on the methodology situated between empirical psychology and philosophy in (...) reference to the debates caused by psychological and philosophical situationism. In response to its criticism against virtue ethics, the possibility of reconstructing it on empirical psychology has paradoxically emerged. Similarly, this study validates assumptions on political philosophies employing the psychological method concerning well-being. Accordingly, the central part examines the plausibility of the assumptions by empirical evidence obtained from two internet surveys in Japan. The relationships between citizenship, justice, and well-being are the most substantial in the communitarian assumption. The exploratory factor analysis of the two surveys illuminates that the correlations between citizenship, justice, and well-being are substantial. This relationship denies the egoism assumption. Moreover, almost all correlations between the three are higher based on virtue-related indicators than hedonic ones. These findings are not in tune with the utilitarian assumption and are most congruent to the communitarian assumption. In addition, citizenship and justice correlate more with political well-being than overall well-being. As these are more directly associated with political well-being in the communitarian assumption, this result aligns with the assumption. Furthermore, the positive relationship between disparity elimination and well-being fits the liberal rather than the libertarian assumption. Nevertheless, the substantial correlation between ethical justice and well-being is higher by virtue-related indicators than hedonic indicators, suggesting distributive justice is associated with the ethical dimension. Again, this fits the communitarian assumption rather than the liberal assumption. Thus, philosophical psychology empirically verifies the interdependence of the three conceptions and the relative plausibility of the communitarian assumption. Moreover, as the relationship between the three is essential for political philosophies, the result increases the reliability of communitarianism. (shrink)

In the first part of this paper, I discuss the different kinds of objectivity; general and legal objectivity more specifically. In the second part, I endeavour to explain the two main views that have been advanced to answer four core questions on legal objectivity. The first is whether moral and legal values are objective. Second, what is the nature of the relationship between legal and moral values? The third is whether, due to the specific nature of law, we should consider (...) a domainspecific conception of objectivity for legal values. The fourth concerns whether there is a correspondence between legal values and legal facts. What is the explanation of the platitudes about the nature of law such as that law is reasongiving, normative or authoritative in character? In other words, do legal facts have a place in our 'disenchanted' or naturalistic (in the scientific sense) understanding of the world. In the final section of this paper, I evaluate naturalism and nonnaturalism in law and consider the future of the debate and its relevance for understanding the connection between law, morality and legal normativity. In this paper I propose to conceive of forgiveness as a process of eliminating punitive reactive attitudes, which makes up part of the offended person’s willingness to reestablish a certain type of reciprocal relationship with the offender. Distinguishing among types of reciprocity allows us to realize that forgiveness is a more varied phenomenon than is usually assumed in the philosophical literature, as well as to understand why the dispute concerning the gratuitousnessconditionality of forgiveness is meaningless.

Are intelligent machines really intelligent? Is the underlying philosoph- ical concept of intelligence satisfactory for describing how the present systems work? Is understanding a necessary and sufficient condition for intelligence? If a machine could understand, should we attribute subjectivity to it? This paper addresses the problem of deciding whether the so-called ”intelligent machines” are capable of understanding, instead of merely processing signs. It deals with the relationship between syntax and semantics. The main thesis concerns the inevitability of semantics for any (...) discussion about the possibility of building conscious machines, condensed into the following two tenets: ”If a machine is capable of understanding (in the strong sense), then it must be capable of combining rules and intuitions”; “If semantics cannot be reduced to syntax, then a machine cannot understand.” Our conclusion states that it is not necessary to attribute understanding to a machine in order to explain its exhibited “intelligent” behavior; a merely syntactic and mechanistic approach to intelligence as a task-solving tool suffices to justify the range of operations that it can display in the current state of technological development. This article contends that Dworkin's notion of ‘genuine’ theoretical disagreements, which is a fundamental pillar in his criticism of legal positivism and semantic disagreements, requires a realist reinterpretation. This view is defended according to two core arguments. First, a realist reinterpretation of ‘genuine’ theoretical disagreements enables Dworkin to avoid semantic criticisms such as the one advanced by Joseph Raz, who propounds a sophisticated model of criterial semantics to explain theoretical disagreements. Second, to make intelligible the distinction between theoretical and semantic (...) disagreements in law, we need to resort to realist elements. The conclusion is striking and in clear contradiction with Dworkin's ametaphysical and epistemic abstinence. The article shows that there is a problematic tension within Dworkin's constructivist project and that he should revise either its ametaphysical view and epistemic abstinence, or notions such as ‘genuine’ theoretical disagreements. A finales de septiembre de 2019, se publica Folie, langage, littèrature que se suma a la anterior colección de textos inéditos de Foucault en torno a la literatura que en 2013 aparecía bajo el título de La gran extranjera. Este nuevo volumen presenta textos inéditos donde los editores, nos dice Judith Revel, han seleccionado textos que vienen a incomodar la lectura canónica del Foucault interesado por la literatura. Y, efectivamente, la selección es especialmente interesante para los estudiosos de su obra (...) porque sitúa su ruptura con un concepto escapista de la literatura en torno a 1967. Particularmente llamativo es el texto «L’extralinguistique et la littérature», donde Foucault propone un análisis de los distintos modos en que lo extralingüístico, como afuera de la obra, se relaciona con ella y viceversa. A partir de esta propuesta, nuestro objetivo es analizar una política de la forma literaria que en Foucault se propone desde una materialidad negativa, a la vez que performativa. (shrink)

Finnegans Wake es la última obra escrita por el escritor irlandés James Joyce. En ella, la creciente complejidad narrativa que lo caracterizó alcanza niveles extremos, rozando lo ininteligible. El autor no sólo mezcla diferentes idiomas, también inventa nuevos términos que germinan y se significan, en gran medida, desde su dimensión sonora. Personajes, y acontecimientos reales y ficticios se mezclan, formando una amalgama donde variantes de arquetipos mitológicos transcurren una glocalidad cíclica perpetua. La protagonista femenina, Anna Livia Plurabelle (ALP), es un (...) personaje mutante que deviene diferentes elementos naturales a lo largo del texto. El murmullo del río se confunde con el suyo propio, en un pulso narrativo que sobrescribe la orilla en la historia. De fondo siempre se oyen voces y, aunque no son claras, sugieren. Esta obra literaria no se lee, se escucha; no se entiende, se deduce. La presente investigación se sitúa en el contexto actual de auge en la aplicación de la Inteligencia Artificial (IA) al procesado de textos. Somete a prueba la transcripción realizada a partir de la locución de algunos pasajes de Finnegans Wake, evaluando el grado de acierto y los posibles sesgos o desviaciones de los resultados. En el presente trabajo intentaremos mostrar que la filosofía de Nietzsche, contrariamente a lo que se ha sostenido en demasiadas ocasiones, es también una filosofía política. Ese pensar político evidenció, por lo demás, un sesgo eminentemente reaccionario y elitista. Cualquier discurso político de signo igualitarista producía en los oídos de Nietzsche una lacerante molestia. Nos hallamos ante un pensador tremendo y profundo que reaccionó con sumo horror ante los hechos de la Comuna de París, aplaudiendo su sangriento aplastamiento. RESUMEN La neurociencia ha proporcionado valiosas herramientas para analizar problemas filosóficos; sin embargo, el debate sobre el papel de las evidencias neurocientíficas en la explicación de determinados fenómenos mentales sigue abierto. La discusión se centra en la experiencia mística y sus bases neuronales, lo que permite efectuar consideraciones más genéricas acerca de la legitimidad y el alcance de los razonamientos neurocientíficos cuando versan sobre algunos de los más conspicuos productos de la cultura. In the past decades, with the decline of the Grand Narratives and the subsequent need for new historical and political orientation, literary studies have been reflecting on the role of literature in the world. Together with Jacques Rancière—and in dialogue with Althusser, Foucault, or Fischer-Lichte—the present volume analyzes this political turn of literary studies.

Se presenta en este trabajo la encrucijada actual de la interpretación de la novela más célebre de Gabriel García Márquez dando cuenta, por un lado, de una tradición interpretativa que desde una cierta idea de “lo nacional” relaciona el sentido de la obra con un agotamiento de la historia y, por otro lado, postulando las condiciones de posibilidad de otra interpretación, vale decir, otra tradición interpretativa desde donde leer la novela para hallar en ella otro sentido con relación a la (...) historia. Uterus transplantation (UTx) research has been introduced in several countries, with trials in Sweden and the United States producing successful outcomes. The growing interest in developing UTx trials in other countries, such as Spain, the Netherlands, Japan, and Australia, raises important questions regarding the ethics of surgical innovation research in the field of UTx. This paper examines the current state of UTx in the context of the surgical innovation paradigm and IDEAL framework and discusses the ethical challenges faced by those (...) considering the introduction of new trials. We argue that UTx remains an experimental procedure at a relatively early stage of the IDEAL framework, especially in the context of de novo trials, where protocols are likely to deviate from those used previously and where researchers are likely to have limited experience of UTx. We conclude that countries considering the introduction of UTx trials should build on the strengths of the reported outcomes to consolidate the evidence base and shed light on the uncertainties of the procedure. Authorities responsible for the ethical governance of UTx trials are advised to draw on the ethical framework used in the oversight of surgical innovation. (shrink)

We try to find out if the contents of that romantic “criticism” were collected or assimilated, to a certain extent, by Marx and Engels. En 2014 la Corte Constitucional solicito a varias universidades “un concepto científico acerca de los efectos que para el desarrollo integral del menor podría tener el hecho de ser adoptado por personas de un mismo sexo”. Este concepto fue requerido en virtud de la demanda 10135/14 por parte del ciudadano Diego Andrés Prada Vargas contra los artículos 64, 66 y 68 y contra el artículo primero de la Ley 54 de 1990, los cuales excluyen a parejas del mismo sexo para (...) la adopción. Por solicitud del director del Departamento de Psicología, elabore un concepto ratificando lo planteado en Domínguez, al mostrar que los estudios internacionales desde el repertorio empirico-analitico han comprobado que el cuidado y la proveeduría dependen cada vez menos del género y la orientación sexual. La corte constitucional nuevamente desconoció los conceptos científicos favorables a las familias homoparentales, y solamente ratifico la adopción en el caso de que uno de los integrantes de la pareja fuera la madre biológica o el padre biológico. Al continuar la controversia, propongo revisar las reclamaciones de justica de la demanda 10135/14 desde las propuestas de un “pacto de cuidado” y de “neutralidad con respecto de Appiah en cuanto a: el reconocimiento a las personas del mismo sexo de su “deseo de vivir bien”, la obligatoriedad de reglamentar la adopción para personas del mismo sexo o la custodia para padres biológicos en esta situación ; y la inclusión dentro del pacto de cuidado de hijas o hijos de familias homoparentales en la educación al valorar la donación por parte de las parejas homosexuales de una socialización primaria basada en la estima y el respeto. Primero, presento las avances de la jurisprudencia colombiana frente a los derechos de los homosexuales, muestro como la solicitud de conceptos psicológicos sobre las personas homosexuales ha sido una estrategia dilatoria, y propongo revisar las pretensiones de la demanda 10135/14 en cuanto a las razones suficientes para encontrar una distancia justa hacia el derecho a un pacto de cuidado para la _debida inclusión_ de familias monoparentales en los beneficios y obligaciones frente al estado. Esta investigación busca comprender el sustrato emocional en los planes de vida de los jóvenes universitarios, en cuanto a sus juicios de valor sobre una vida digna y buena en situaciones de vulnerabilidad, así como la intencionalidad y los modos de comunicación de estos en la experiencia universitaria. A partir de la propuesta investigativa hermenéutica narrativa de Quintero-Mejía, se interpretaron las emociones morales presentes en las tramas de planes de vida de los estudiantes de la Universidad Nacional de Colombia. El (...) autoexamen reveló los conflictos emocionales sobre las situaciones vulnerables que escaparon al control, y los juicios reconstructivos mostraron cómo el miedo, la culpa, la vergüenza o la humillación afectaron el equilibrio emocional. Además, cada estudiante mostró, los juicios compromisorios para el bien propio y creencias hacia el bien común. (shrink)

Este trabajo tematiza el contraste entre la Novela Histórica Tradicional y la Nueva Novela Histórica en el contexto colombiano de la segunda mitad del siglo XX en cuanto a la representación del pasado nacional y, en particular, en cuanto al lugar del Otro en el tiempo/espacio de ese pasado. Se postula que los escritores colombianos de la Nueva Novela Histórica, al tematizar la presencia del Otro culturalmente diferente al sujeto de la élite republicana, son un antecedente cultural de la Constitución (...) política del 91, que reconoce la calidad pluricultural de la nación colombiana. This paper analyses the contrast between the Traditional Historical Novel and the New Historical Novel in the Colombian context of the second half of the XX century with reference to the representation of the national past and specifically referring to the estimation of the other as far as time and space in the past is concerned. i will argue that Colombian writers of the New Historical Novel mark the presence of the Other, who is culturally different from the republican elite, the main subject, and thus these works become the cultural background of the Political Constitution of 1991, that recognizes the multicultural situation of the Colombian nation. An introduction by Veronica Rodriques-Blanco to A Symposium on the Nature of Legal and Political Authority.

This paper analyses and criticizes Joseph Raz's attacks on coherentist theories. It is argued that Raz's characterisation of epistemic coherence theories is too narrow and that his criticism of constitutive coherence theories is based on a conceptual mistake in his own description. The study is an indirect argument to rethink coherence theories of law and adjudication within a more powerful framework than that propounded by Raz.
